AGB

1.General
The terms of conditions follwing are valid for all of our sales. We are not bound to purchasing terms from our customers even if we do not oppose. When our order acknowledgement or delivery is accepted, our terms of sales and terms of payments are effective.

2.Offers
Our offers are without obligation. We will commit ourselves to incoming orders only when we acknowledge them in written format. Verbal arrangements and statements are without any obligation. In case of a negative credit check concerning the customer, we reserve the right to withdraw from the order acknowledgement.

3.Orders
All orders as well as changes of orders must be received in written format.

4.Deliveries
All deliveries will be made ex works. Unless a carrier is specified, the factory will determine the "Best Way" to ship orders. The factory reserves the right to ship up to +/- 5% of the quantity ordered and customer will be invoiced accordingly.

5.Claims
Claims must be made no later than 30 days after ship date in written format.

6.Packaging
Transport packaging will be invoiced at cost price.

7.Terms of payments
Payments made 14 days after receipt of delivery can be discounted with 2 % of the total invoice amount; otherwise 30 days net. Should these terms be neglected, the factory reserves the right to charge interest rates according to the current bank interest rates. Payments before delivery are requested from customers with no credit or negative credit history.

8.Claim of property
Merchandise delivered will remain our property until we have received the full payment invoiced.
Should the customer resell the merchandise before having paid to us, these receivables will be ceded to us. If the customer collects money out of those receivables, we are entitled to collect our claim from this amount.

9.Place of fulfillment and legal domicile
Place of fulfillment for deliveries and payments is Veitsbronn, Germany.
Place of legal domicile for both parties is the district court of Fürth, Germany.
